1. Agreement to Terms

By accessing or using the services provided by Born Free Bar Staffing ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service.

2. Services

Born Free Bar Staffing provides mobile bartending and related event staffing services as described on our website and in individual service agreements. All services are subject to availability and the terms outlined in a signed contract or proposal.

3. Booking and Payment

To secure services, a signed agreement and a deposit are typically required. The deposit amount, payment schedule, and cancellation policy will be specified in your individual service agreement or proposal. Full payment is generally due prior to the event date. We accept various payment methods which will be communicated during the booking process.

4. Client Responsibilities

Clients are responsible for providing a safe and suitable environment for our staff and services. If alcohol is client-provided, the client is responsible for its legal purchase and ensuring it is of good quality. The client must ensure that all event attendees consuming alcohol are of legal drinking age. We reserve the right to refuse service to any individual who appears intoxicated or is underage.

5. Cancellations and Refunds

Cancellation policies are detailed in the individual service agreement. Deposits are generally non-refundable as they secure the date and our resources for your event. Refunds for other payments will be handled according to the terms of the signed agreement.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Born Free Bar Staffing, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii.e.) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Our total liability for any claim arising out of or relating to these Terms or our services will not exceed the amount paid by you to us for the services in question.

7. Indemnification

You agree to defend, indemnify and hold harmless Born Free Bar Staffing and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
